The terms we supply goods and fabrication work on.
This page is a starting point written against Australian law. It has not been reviewed by a lawyer, and sections marked [confirm] need details only Total Store Solutions Pty Ltd can supply. Have it checked before relying on it.
These terms apply to all goods and fabrication work supplied by Total Store Solutions Pty Ltd from 7 Angel Rd, Stapylton QLD 4207. Placing an order means you accept them.
[confirm] If you have separate signed trade account terms or a credit application, say here which document prevails. Two sets of terms that contradict each other is the most common cause of a disputed invoice.
1. Quotes
- Quotes are based on the information, drawing or parts list you give us. If that changes, the price changes.
- [confirm] How long does a quote stand? 30 days is common, but steel and copper pricing moves — state your actual validity period.
- A quote is not an offer to sell until we accept your order.
- Prices are quoted per account and are exclusive of GST unless stated otherwise. [confirm]
2. Orders
- An order is accepted when we confirm it in writing or begin work on it.
- Stock is not reserved until an order is accepted.
- You are responsible for the accuracy of what you order — part numbers, quantities, dimensions and materials.
3. Fabrication work
- We fabricate to the drawing, DXF, DWG or measurements you supply. We do not verify that a design is fit for its intended purpose, structurally adequate, or compliant with any standard, unless we have agreed in writing to do so.
- Where you ask us to site-measure, we will confirm the measurements with you before cutting.
- [confirm] State your manufacturing tolerances. Without a stated tolerance, a dispute over a 1 mm variance has no reference point.
- Custom-fabricated items are made to your specification and cannot be returned for change of mind. See our returns and refunds page.
4. Delivery and collection
- We deliver across Brisbane, Logan, Gold Coast, Ipswich. Delivery timeframes are estimates, not guarantees, and we are not liable for delays outside our control.
- Risk in the goods passes to you on delivery or collection. [confirm]
- Please inspect goods on arrival and tell us about damage or shortages promptly. [confirm] Nominate a period — 48 hours or 7 days are both common.
- Goods held for collection beyond [confirm] may incur storage charges.
5. Payment
- Counter sales are payable at the time of purchase.
- Trade account terms are [confirm] — for example, strictly 30 days from end of month of invoice.
- [confirm] State any interest on overdue amounts and whether recovery costs are payable. Unfair contract term rules apply to standard-form contracts with small businesses, so an excessive rate can be struck out.
- Title in the goods does not pass to you until payment is received in full. [confirm] A retention of title clause is only effective against third parties if it is registered on the Personal Property Securities Register (PPSR). Get advice before relying on this.
6. Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
Where the law permits us to limit our liability, our liability for a failure to comply with a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
7. Warranty
- Manufactured products carry the manufacturer's warranty. We will help you make a claim.
- [confirm] State your own warranty on fabrication workmanship and its period.
- Warranty does not cover fair wear and tear, incorrect installation, misuse, modification, or use outside the product's rated conditions.
- These warranties are in addition to, not instead of, your consumer guarantees.
8. Liability
Subject to clause 6, and to the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of contract, or downtime costs. [confirm] Any overall liability cap should be set with legal advice — a cap that is unreasonable may be unenforceable as an unfair contract term.
9. Governing law
These terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
